Steps to Take After an Accident

  1. If there are injuries, call 911 immediately.
  2. If no injuries are immediately apparent:
    • Exchange information with the other driver (insurance details, driver’s license numbers, and license plate information).
    • Always report the accident to your insurance company, even if there is no visible bodily injury or vehicle damage. This is essential because Pennsylvania allows a two-year statute of limitations. If you develop symptoms related to the accident within two years, your medical expenses will be covered under your automobile insurance.

If You Develop Symptoms After the Accident

  1. Notify your insurance company and obtain:
    • A claim number (share this with all healthcare facilities treating you).
    • The name and contact information of your claim representative (this is different from your insurance agent).
  2. Seek medical attention:
    • Visit the emergency room of any hospital.
    • Call your family physician.

  3. Complete the Application for Medical Benefits sent by your insurance company.
    • This form must be filled out by you (not your physician) to open the medical claim.
    • It details your symptoms and their connection to the auto accident.
    • Without completing this form, your medical expenses will not be covered.

Coverage Under Pennsylvania Act 6

  • All accident-related medical treatment is covered 100%, with no co-pays, regardless of the health facility you choose.
  • Each person has a minimum of $5,000 coverage for medical expenses under their auto insurance policy. Check your policy or contact your claim representative for exact coverage limits.

Examples of Coverage Scenarios

  1. Driver of a Vehicle Hit by Another Vehicle:
    • Your auto insurance pays your medical expenses.
    • The at-fault driver’s insurance covers vehicle damage.
  2. Passenger in Your Own Vehicle:
    • Your auto insurance pays your medical expenses.
    • The at-fault driver’s insurance covers vehicle damage.
  3. Passenger in Another Vehicle:
    • Your own auto insurance pays your medical expenses.
    • The at-fault driver’s insurance covers vehicle damage.
  4. Passengers Without Auto Insurance:
    • If the passenger does not have their own auto insurance, coverage is provided by:
      • The auto insurance of someone they live with, or
      • Your auto insurance (if the passenger lives with you).

Exhausting Medical Coverage

  • If your auto insurance medical coverage runs out:
    • Claims are sent to your health insurance company.
    • If no health insurance exists, arrangements must be made with your healthcare providers.
